Terms of Service

1. The Service

Rushback provides a re-engagement automation platform that allows dive centers to send automated email campaigns to lapsed diver contacts. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 18 years old to use Rushback.

3. Acceptable Use

You agree not to use Rushback to:

• Send unsolicited emails or spam to contacts who have not consented to receive communications from your dive center.
• Violate any applicable laws or regulations, including anti-spam laws (CAN-SPAM, GDPR, CASL).
• Upload contact data that you do not have the right to use.
• Attempt to gain unauthorized access to any part of the service.
• Distribute malware or engage in any activity that disrupts or damages the service.

4. Your Diver Data

You retain full ownership of the diver contact data you import into Rushback. By uploading data, you represent that you have the legal right to use it and to send marketing communications to those contacts. You are responsible for ensuring your use of Rushback complies with applicable data protection and email marketing laws in your jurisdiction.

5. Payment & Billing

Paid plans are billed monthly in advance. All fees are non-refundable unless required by law. We may change our pricing with 30 days' written notice. If you fail to pay, we may suspend or terminate your account. You can cancel your subscription at any time; your access will continue until the end of the current billing period.

6. Intellectual Property

Rushback and its content, features, and functionality are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the service without our written consent. Your content and data remain yours; you grant us a limited licence to process it solely to provide the service.

7. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that it will meet your specific requirements. Email deliverability depends on factors outside our control, including recipient email providers and spam filters.

8. Limitation of Liability

To the fullest extent permitted by law, Rushback shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including lost revenue, lost data, or loss of business opportunities. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. You may terminate your account at any time by contacting us. Upon termination, your data will be deleted within 30 days in accordance with our Privacy Policy.

10. General

These Terms are governed by and construed in accordance with applicable law. If any provision is found to be unenforceable, the remaining provisions will continue in full force. We may update these Terms from time to time; we will notify you by email of material changes. Continued use of the service after changes constitutes acceptance of the new Terms.
